  1. Organiser:
    The International Song Festival Gdynia OPEN is organised by Youth Community Centre in cooperation with Social Innovation Laboratory (LIS).

  1. Aim:
    Gdynia OPEN 2022 festival is organized to:
    • Popularize polish and other global songs of different subject matters
    • Support talented people from Poland and other countries
    • Develop music and aristic passions and interests
    • Integrate artistic community
  1. Place and time:
    1. The festival will last from 27.06 to 03.07.2022
    2. The festival consists of four stages:
      • I stage – registering applications from 03.03 to 10.04.2022 – extended to 24.04.2022
      • II stage – publication of the list of qualified people after initial verification by 29.04.2022 on www.gdyniaopen.pl, www.mdk.gdynia.pl and on social media
      • III stage – live auditions from 27.06 to 01.07.2022
      • IV stage – the announcement of the results during the final concert – 03.07.2022
    3. The auditions will take place from 27.06 to 01.07.2022 in the concert hall of Music School at 13A Biskupa Dominika Street in Gdynia.
    4. The winners’ concert will take place on 03.07.2022 at the Concert Shell at Grunwaldzki Square in Gdynia.
    5. The Organiser is entitled to change the place of the auditions and the final concert.

4. Costs and payment:

Non-refundable enrty fee – 50 PLN for each presentation (song) must be paid together with the application. Payment should be done on Youth Center’s, 2 Grabowo Street, 81-265 Gdynia: PKO BP 46 1440 1026 0000 0000 1253 0625 by 10.04.2022 extended to 24.04.2022 (date of payment to the account decides) with the following information added: Entry fee/the name and surname of the person/persons performing. After the payment the performers are asked to send the confirmation of the payment on: gdyniaopen@mdk.gdynia.pl.

Each qualified person is obliged to make a non-refundable payment for participating in the festival in the amount of 90 PLN for each participant and in case of more presenations (duet or band) – 60 PLN. Payment should be done on Youth Center’s , 2 Grabowo Street, 81-265 Gdynia: PKO BP 46 1440 1026 0000 0000 1253 0625 by 25.04.2022 extended to 09.05.2022 (date of payment to the account decides) with the following information added: Accreditation/the name and surname of the person/persons performing. After the payment the performers are asked to send the confirmation of the payment on: gdyniaopen@mdk.gdynia.pl.

5. Participation conditions:

  1. In order to participate in the Festival it is essential to fill in an Application Form which can be found on www.gdyniaopen.pl in GDYNIA OPEN from 01.03 till 10.04.2022 – extended to 24.04.2022 – with files attached: half playback and YouTube link with the recorded song of the conestant.
    • Contest video should be placed on a private youtube.com with the following information:
      • name and surname of the contestant
      • age category (the year of birth is taken into cosideration)
      • title of the song
      • postscript: Gdynia Open 2022
      • Example: John Kowalski, 14–17 years old, ,,Title of the song“, Gdynia Open 2022
    • Contest video sholud be filmed horizontally and from one camera shot not neccessarily static one. The video can be recorded in home environment. The usage of microphone is not necessary but acceptable.
    • Presented song must have a well-heard voice and background music or accompaniment (only vocal presenations of the soloists will be evaluated).
    • Any interference in the recording by post-production is unacceptable.
    • Any kind of audio-video editing is unacceptable.
  2. Sending of the Application Form mentioned in point 5.1 is equivalent to the acceptance of this Regulations.
  3. Lack of any of any of the payments on time will result in disqualification of the contestant.
  4. In case of resigning from the festival the organiser do not provide refund of the payments.
  5. Each paricipant is obliged to submit to the Organiser the original statements and consents, on the day of arrival at the latest . The statements and consents, which are attachements to this regulations, must be printed and signed by the parents or legal guardian of the conestants.
  6. Lack of any documents mentioned in point 5, filling them incorrectly or submitting copies will result in disqualification the contestant.

6. Participants:

  1. Children from the age of three, youth and adults can participate in Gdynia OPEN 2022 festival.
  2. In the festvival can take part vocalists singing solo, in duets or bands up to 9 people.
  3. Soloists and duets can be accopmanied by vocal section up to 6 people. The age of the people performing in the vocal sections do not have any influence on the qualification of the contestas to a oproper age category.
  4. Age categories – soloists and duets:
    • Up to 10 years
    • Form 11 up to 13 years
    • Form 14 up to 17 years
    • Form 18 + (open)
  5. Age categories – vocal bands:
    • Up to 12 years
    • From 13 up to 17 years
    • From 18 + (open)
  6. In case of duets and bands the year of birth of the oldest participant determines the age category.
  7. Both participants and parents/legal guardians should have valid identity document.

7. Festival schedule:

  1. During the course of the festival each participant will perform one song, whose length must not exceed 4 minutes and 30 seconds.
  2. It is not acceptable to change the repertoire after being qualified to participate in the festival after sending the appliction form.
  3. Performances of the contestants will be evaluated by the jury chosen by the organizer. The decisions of the jury will be based on their knowledge, experience and skills. The decisions made by the Jury are idisputable and final.
  4. When evaluating the contestants the Jury will take into consideration:
    • vocal qualities
    • selection of the repertoire adjusted to the age of the contestant
    • interpretation of the song
    • musicality
    • sense of rythym
    • artistic expression.

8. Prizes:

  1. Winners in the age category up to 10 years will receive statuettes of „Smiling Fishy“ and a material prize.
  2. Performes selected in the age categories from 10 years above will receive the statuettes: „Gold Fishy“, „Silver Fishy“ and „Bronze Fishy“ and a financial prize. The Jury will also award Grand Prix and a special award for personality of the festival.
  3.  The Jury will award the prizes as follows:
    • Grand Prix – 1000 PLN
    • Special prize for Personality of the Festival – 500 PLN
    • Soloists and duets:
      • I prize – 500 PLN
      • II prize – 400 PLN
      • III prize – 300 PLN
    •  Vocal bands:
      • I prize – 700 PLN
      • II prize – 600 PLN
      • III prize – 500 PLN
  4. The Jury has the right to change the amount and the alocation of the awards in each category.
  5. The condition to receive the prize is to submit the signed original statement of being awarded the prize by 17.07.2022 at the latest. In case of not fulfilling the condition the prize will be lost.

9. Organizational rules:

  1. Choirs are not allowed to take part in the Festival.
  2. The Organiser does not refund the costs of accommodation and travelling expenses.
  3. The Organiser informs that there is possibility of accommodating the performers, instructors from 26.06.2022 (from 4pm) till 04.07.2022 (to 12.00) in Primary school nr 3, 73 Nagietkowa Street in Gdynia. The number of places is limited.Order of applications will count. Applications can be made by sending mail to: sekretariat@sp47.edu.gdynia.pl with information: ,,nocleg Gdynia Open‘‘.
  4. In case of resignation from the Festival the fee for accommodation will not be refunded.
  5. People or institutions delegating performers or bands to take part in the festival are obliged to provide insurance for each person during the travel and stay at the festival.
  6. The Organiser informs that participants of the Festival are obliged to use artistic works with respect of the copyright or related rights of their authors, performing artists and producers.
  7. The Organizer points out that parents or legal guardians are responsible for their contestants during the festival. Each institution or person delegating the person to the festival should ensure the appropriate number of guardians.
  8. The Organizer informs that the festival can be recorded and promoted by all known means , can be registered on DVD and also by TV or Internet. Applying for the festival means giving consent to processing the image free of charge. This consent includes any forms of posting especially distributing in the Internet.
  9. Everybody takes part in the festival at his/her own risk.
  10. The Organiser is not responsible for any material damage made by participant against other people during the festival.
  11. The Organiser is entitled to change the Regulations, the date of the Festival, or cancel the festival without justification.
  12. All matters not included in the above Regulations will be settled by the Organiser in agreement with the Jury.
  13. The final interpretation of the Regulations belongs to the Organiser.

10. INFORMATION CLAUSE:

I consent to the processing of my personal data/my child’s personal data and I declare that I have been informed that:

  1. The administrator of your personal data is Młodzieżowy Dom Kultury (Youth Community Centre) with the registered office in Gdynia (81-265) at 2 Grabowo Street, phone nb. +48 58 6988618, e-mail: biuro@mdk.gdynia.pl.
  2. The administrator of personal data appointed the Data Protection Officer supervising the processing of personal data. Contact with the Data Protection Officer on e-mail address: edu.iod@gdynia.pl.
  3. In order to organize, prepare, conduct and promote International Song Festival Gdynia OPEN 2022 (hereinafter referred to as the Festival), the personal data administrator processes the personal data of people participating in the Festival: Participant (child, adult), parents/legal guardians, artistic guardians, teachers, authors of works and people cooperating with the Organizer as part of the above-mentioned Festival.
  4. The personal data administrator processes personal data of the above-mentioned persons in the following scope:
    • personal data of the Festival Participant (child, adult), such as: name and surname, year of birth, image (photo, recording – competition film), contact details;
    • personal data of the submitting person – legal representatives of the Participants, such as: name and surname, contact details, including contact e-mail and telephone number, bank account number (payment of the registration fee);
    • personal data of the teacher or artistic supervisor under whose supervision the work was performed, such as: name and surname;
    • personal data of the authors of works (text and music), such as: name and surname.
  5. The basis for the processing of personal data is consent to the processing of personal data – art. 6 sec. 1, point a of the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as GDPR) in connection with Art. 81 sec. 1 of the Act of February 4, 1994 on copyrights and related rights (i.e. Journal of Acts of 2021, item 1062), art. 63 of the Act of April23, 1964 of Civil Code (Journal of Acts of 2020, item 1740, as amended), art. 93 of the Act of February 25, 1964 of Family and Guardianship Code (Journal of Acts of 2020, item 1359) and in cases where required by the provisions of the Act of July 14, 1983 on the national archival resource and archives (Journal of Acts of 2020, item 164, as amended).
  6. Providing data is voluntary, but necessary to achieve the purposes for which it was collected, and without providing it, it will not be possible to participate in the Festival.
  7. If you provide your e-mail address or telephone number, it may be used by the Organizer to contact the Participant in matters related to the Festival.
  8. Personal data, including the image of Participants, may be made available in connection with the announcement of the results of the Festival and the award ceremony and with promotion of the Festival on the MDK websites, during events organized by the Director of MDK (e.g. publicaion of laureates‘ personal data, public presentation of the image – photo and competition film) and on social services such as YouTube and Facebook. We inform you that the servers of YouTube and Facebook are located in the United States of America, where other provisions on the protection of personal data apply –portals support the global infrastructure and process data both within the EEA (European Economic Area) and outside it – additional information is provided on the website: https://policies.google.com/privacy?gl=PL&hl=pl#products and https://www.facebook.com/business/gdpr.
  9. In order to create a cooperation network and promote the Festival, personal data included in the Festival’s documentation (including the “Application form”) may be disclosed to partners supporting or co-organizing the Festival.
  10. Personal data of the Participants, parent/legal guardian, person representing the minor Participant of the Festival will be kept for the period necessary to achieve the purpose for which you consented, but also for archival purposes in accordance with the provisions of the Act of July 14, 1983 on the national archival resource and archives (Journal of Acts of 2020, item 164, as amended).
  11. You have the right to access the content of the data and receive a copy of it and the right to rectify it, if it is incorrect or out of date, delete it, limit processing, subject to the cases referred to in art. 18 sec. 2 GDPR, and the right to withdraw consent at any time (this will not affect the lawfulness of the processing that was carried out before the withdrawal of such consent).
  12. The obtained personal data will not be processed in an automated manner and will not be profiled.
  13. The recipients of your data will be entities to which personal data should be made available in order to fulfill the legal obligation, as well as entities to which the data will be entrusted to achieve the purposes of processing (including accounting and financial services – CUPSZ, providers of IT solutions and technical assistants, postal operator).The data of the winners will be additionally entrusted to the Social Innovation Laboratory (a budget unit of the Gdynia City Commune) in order to fund and pay out financial awards. If the need to transfer data to recipients other than in the preceding sentence is revealed, you will be informed separately.
  14. You have the right to lodge a complaint with the President of the Protection Data Office, 00-193 Warsaw, 2 Stawki Street.

The image of the Festival Participant will be recorded in various forms of electronic processing (including photography, data streaming and film documentation) by Youth Community Centre based in Gdynia at 2 Grabowo Street, as part of the organization, implementation and promotion of the International Song Festival Gdynia OPEN 2022. This consent is free of charge, not restricted by the amount or territory and covers the above-mentioned forms of publication, in particular, distributing in the Internet, including on the Festival’s website gdyniaopen.pl, the website of Youth Community Centre and social networks such as YouTube and Facebook (we inform you that the servers of YouTube and Facebook are located in the United States of America, where other provisions on the protection of personal data apply –portals support the global infrastructure and process data both within the EEA (European Economic Area) and outside it – additional information is provided on the website: https://www.facebook.com/business/gdpr).

The image of the Festival Participant will be electronically processed, cropped and composed, as well as juxtaposed with the image of other people, may be supplemented by an accompanying comment, while film and sound recordings with my participation / with my child’s participation may be edited, modified and added to other materials created for the purposes of the event without the obligation to accept the final product.

The image cannot be used in any offensive way or insult personal rights and interests.

I, the undersigned __________________________________________, as the author/legal representative of the child/mentee ____________________________________________ who is the author (co-author) of the recording/film, declare that I am entitled to transfer the proprietary copyrights to the recording to the extent indicated in this statement.

As the author/legal representative of the author, I transfer free of charge to the Organizer – Youth Community Centre in Gdynia – the proprietary copyrights to the recording/film, as well as dependent rights, including the right to develop the recording by adapting it, and the Festival Organizer declares that he accepts economic copyrights for recording/film.

Proprietary copyrights to the recording/film, along with dependent rights, are transferred to the Organizer at the time of signing this statement and give the Organizer the unlimited in time right to use and dispose of the recording/film, including permission to dispose and use of the recording/film in Poland and abroad without the Organizer incurring additional fees. The Organizer acquires proprietary copyrights and subsidiary rights in the following fields of exploitation:

  1. production of an unlimited number of copies of recordings/films using printing, reprographic, IT, photographic, digital, optoelectric, magnetic, audiovisual or multimedia techniques;
  2. placing the originals or copies of recordings/films on the market, renting or lending the original or copies on which the recordings/films have been recorded without subject, territorial and time limitations, regardless of the intended use;
  3. entering into computer memory and operating systems; disseminating in IT or teleinformation networks, including the Internet (including social networking sites such as Facebook, YouTube) in such a way that access to films by third parties is possible at the place and time chosen by them;
  4. public performance, exposure, presentation, reproduction, broadcasting;
  5. rebroadcasting, including via cable and satellite networks;
  6. use for informational, promotional and advertising purposes.

As the author/legal representative of the author of the recording/film, I allow the Organizer to arrange and use of other versions of the recordings/film to the extent indicated above and transfer to the Organizer the right to grant permits in this regard for the disposal and use of other versions of the recordings/film.

As the author/legal representative of the author of the recording/film, I declare that the recording/film is made by me/my child/mentee and that in connection with the recording/film and the transfer of proprietary copyrights and subsidiary rights to the Organizer, I do not infringe the rights of third parties in any way.

* I have read the Information Clause of the International Song Festival Gdynia Open 2022 – sec. 10 of the Festival’s regulations and Appendix 3 to the Application Form.

As the author/legal representative of the author of the recording/film, I have written declarations containing the consent of the persons appearing in the recording/film for free use of their image and statements by means of mass media or electronic means in all information activities, promotion and advertising of the Organizer.
